Tenant Deposit Schemes: updated guidance for Landlords

Updated guidance on tenant deposits, disputes and damages for residential landlords has been jointly developed and published by the three deposit protection schemes.

Residential landlords in England and Wales taking a tenancy deposit from tenants in an assured shorthold tenancy are legally required to protect the deposit with one of three government approved providers of deposit protection (the Deposit Protection Service; MyDeposits - including deposits that were held by Capita; and the Tenancy Deposit Scheme.) Since the relevant legislation came into force in 2004, deposits worth billions of pounds have already been protected in deposit protection schemes.

Landlords are also required to give tenants specific information about the scheme chosen within 30 days of the deposit. If this is not given, they may be liable to pay to the tenant a financial penalty of up to three times the deposit at the end of the tenancy, and the landlord is not allowed to give the notice he would usually be able to give to gain possession of the property from the tenant.

This publication, Guide to Deposits, Disputes and Damages, is an important and practical guide to the three tenants’ deposit protection schemes that residential landlords must choose from, and it has been published as “part of their ongoing commitment to maintaining the highest possible standards”. It provides a “transparent, consistent approach to the resolution of deposit disputes, ensuring all tenants and landlords are treated fairly and equally, regardless as to which scheme protects the deposit or the type of protection in place”.

The guide sets out and explains the schemes’ respective dispute resolution procedures, in a visually helpful format which includes useful flow diagrams and plenty of examples. This makes for an informative but easy to read guide for landlords seeking to take the right steps in an efficient and effective way.
