The role of an Expert Witness in a niche area such as supply chain and logistics is one of examining the evidence in full, providing an expert opinion and clarification based on knowledge and expertise in this area.
Judges, barristers, solicitors and juries cannot be expected to fully understand the intricacies of supply chains, warehouses and freight transportation.
This is where an Expert Witness with years of experience in this area can assist.
Although instructed by one side or the other the Expert Witness is expected to provide completely independent, unbiased, impartial evidence to the court or tribunal to assist them in coming to a decision or verdict.
Cases can be civil or criminal proceedings. Expert Witnesses can also be involved in cases of arbitration and appear in tribunals.
The following are examples of where an expert witness can assist in disputes between parties.
CASE STUDY 1 – Expert Witness, 3rd Party Logistics company
The claimant is a global company, ranked among Europe's leading transport and logistics firms. The engagement here entailed producing an Expert Witness report to calculate revenue loss as a result of alleged flaws in the initial floor construction within the warehouse which allegedly resulted in racking being unable to be erected and potential clients being turned away.
This included:
- Ascertaining the market rates for storage and handling over a ten-year period
- Calculating approximate utilization of the warehouse during that time
- Providing supporting data.
This case was settled out of court.
CASE STUDY 2 – Expert Witness – Unfair dismissal
The claimant was an individual who had been dismissed by his company during a period of transitioning from one distribution site to another. The brief was to assess whether the employee had been unfairly dismissed. The case was settled out of court.
"We instructed Gwynne Richards to act as an expert witness in a matter that involved the transfer of warehouse operations between very large warehouse sites. He provided a service that was comprehensive, prompt and added value. He was a calm and authoritative head in a very difficult and demanding situation." David Mann, Aaron & Partners LLP
Case study 3 – Expert Witness – Health and Safety
This engagement was as a result of a local authority being worried about possible Health and Safety issues at a well-known Retailer. Apprise was approached to provide an independent report to determine whether there was a systemic failure of the store replenishment and stock system.
This case was heard in the Crown Court with the Expert Witness giving evidence to the jury.
