This course is aimed at qualified wills and probate and private client practitioners.

Private Client Update
This session will provide a comprehensive review of recent developments over the next few months and will examine the implications for private client practitioners. The content will depend on what happens in the next few months but it is likely to include:

- Any developments following the Report of the OTS on simplification of IHT
- An update on developments in probate practice
- An update on tax in relation to estates and trust
- Decisions in the areas of wills, trusts and professional practice with particular emphasis on lessons to be learned and good practice

After completing this session you will be able to:
• identify the impact of recent developments on your day to day practice, and
• make appropriate amendments to your advice and practice.

Dealing with estates and will trusts
This session will look at pitfalls and opportunities for PRs and trustees. There are opportunities to reduce the tax burden on estates significantly but, conversely missing, an opportunity can cost an estate dear. The RNRB has raised the stakes since simple steps taken by PRs and trustees during the two years following death will often allow an estate to benefit from the enhanced nil rate band even though the terms of the will, as written, mean that the estate does not qualify. Lesley has just finished writing “Varying the Disposition of Estates after Death” for Law Society Publications and will draw on this for the relevant section of the session.

• Altering the disposition of estates
o Post-death variations and disclaimers
o IHTA 1984, s144
• CGT and appropriation of assets

After completing this session you will be able to:
• Identify situations where loss on sale relief is available and take steps to maximise its benefit
• Use post-death variations and disclaimers to improve the IHT and CGT position on death
• Recognise the benefits and pitfalls of reading back under IHTA 1984, s144, and
• Reduce the CGT burden on estates by appropriating assets.
